These Terms and Conditions ("Terms") govern your use of the coaching services provided by Nagle Performance Ltd ("we", "us", "our"), a company registered in Scotland. By purchasing or participating in any of our services, you agree to these Terms in full.
We provide online fitness coaching services including but not limited to: personalised training programmes via Trainerize, group coaching cohorts, video content, nutritional guidance, and community support. Services are delivered digitally via Trainerize and Pulse (LeadConnector) platforms.
You must be 18 years or older to purchase our services. By completing the PAR-Q (Physical Activity Readiness Questionnaire) during onboarding, you confirm that you are medically fit to participate in a structured exercise programme. If you answer "yes" to any PAR-Q question indicating elevated risk, you must obtain medical clearance before commencing training. We reserve the right to withhold access pending clearance.
All payments are processed securely via Stripe or Pulse. By completing checkout you authorise the applicable charge. Prices are as displayed at the time of purchase on the relevant product or booking page.
Recurring subscriptions continue until cancelled. You may cancel at any time via your account or by contacting andy@andynagle.com. Cancellation takes effect at the end of the current billing period.
We offer a 30-day "do the work" refund guarantee on the 6-week cohort. To qualify: (a) you must request the refund within 30 days of the start date; (b) you must have completed all assigned workouts and submitted all required check-ins and progress photos during that period; (c) you must demonstrate you have followed the programme as prescribed and seen no measurable improvement. Refund requests are subject to review. Approved refunds are processed within 10 business days. Monthly subscriptions are non-refundable once a billing period has commenced.
Our services provide general fitness coaching and do not constitute medical advice. You participate at your own risk. We strongly recommend consulting your GP before starting any new exercise or nutrition programme, particularly if you have a pre-existing medical condition, injury, or are returning from illness. We accept no liability for injury, illness, or adverse outcomes arising from participation in our programmes.
To the maximum extent permitted by law, Nagle Performance Ltd shall not be liable for any indirect, incidental, special, or consequential loss or damage arising out of or in connection with our services, including but not limited to loss of income, loss of data, or physical injury. Our total liability in any circumstances shall not exceed the amount paid by you for the relevant service in the preceding 3 months.
All content provided through our services — including but not limited to training programmes, videos, PDFs, scripts, and nutritional guidance — is the intellectual property of Nagle Performance Ltd. You are granted a personal, non-transferable licence to use this content for your own fitness purposes only. You may not share, reproduce, redistribute, resell, or publish any content without prior written consent.
You agree not to: share your account access with others; use our platforms or community spaces to promote competing services; post harmful, offensive, or defamatory content in group communities; attempt to circumvent payment or access controls. We reserve the right to remove you from any programme without refund if these conditions are breached.
Our services are delivered via third-party platforms (Trainerize, Pulse/LeadConnector). While we take reasonable steps to ensure continuity, we cannot guarantee uninterrupted access due to third-party outages or changes. In the event of a material platform failure, we will make reasonable efforts to continue delivery via an alternative method.
We reserve the right to modify, update, or discontinue any service or feature at any time. Where a material change affects a paid cohort already in progress, we will provide reasonable notice and, where appropriate, a proportionate refund.
These Terms are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
We may update these Terms from time to time. The current version will always be available at andynagle.com/terms. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
